Areas of Practice
Legal
We understand the organisational drive to exploit what are significant opportunities for growth in the Middle East. In order to do that, it is imperative that organisations understand the varying legal landscapes in the Middle East as they represents a distinct departure from the UK and other western contracting and legal frameworks. Identifying and understanding these differences is crucial to operating successfully in the Middle East.
We specialise in providing advice on:
Identifying risks and risk mitigation strategies when bidding for a Government or Ministry opportunity.
Joint Venture, Joint Bid and Partnership opportunities.
Specific jurisdictional requirements impacting eligibility to participate in public tenders for e.g. Saudization and Local Content requirements (Saudi Arabia) and Emiratization requirements in the UAE.
The requirements and impact of Government Tender and Procurement Law in both Saudi Arabia and the UAE;
The impact of Labor Law in both the UAE and Saudi Arabia. Employment regulations governing the employment of local nationals v. expatriates differ between jurisdictions in the Middle East and significantly so from the UK. It is critical for organisations to understand their obligations under local Labor Law in the entire life cycle of a particular contract but also on a day to day basis.
Dispute resolution. The need for robust, Shariah compliant contracting procedures and agreements is essential when mitigating against the risk of disputes and alleged breach of contract claims. Courts in Saudi Arabia operate without judicial precedence representing a marked departure from western court and litigation process, this means that the need for contracts to be clear, concise and compliant with local legal requirements is critical.
We have extensive experience in preparing and drafting a wide range of agreements that are now routinely used by large multi-nationals in the Middle East and have in some instances been adopted by various Ministries as their standard contracting template. Below is a small example of the agreements we commonly draft, it goes without saying that we provide ongoing support and advice in the implementation, negotiation and entire life cycle of the agreements we prepare.
Supply of Goods and Services Agreements;
Consulting and Consultancy Agreements;
Teaming Agreements ;
Joint Bid Agreements and Powers of Attorney;
